Terms of Service

1. Acceptance of Terms

By accessing or using kupkaike.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must stop using the Platform immediately.

You must be at least 18 years of age to use Kupkaike. By using the Platform, you represent and warrant that you are at least 18 years old.

Kupkaike is operated by Michael Tremblay, based in Quebec, Canada.

2. Description of Service

Kupkaike is an AI-powered market intelligence and digital product creation platform. The Platform provides:

• Market niche analysis powered by our AI-driven market intelligence engine
• AI-generated digital products (eBooks, templates, planners, checklists, workbooks, prompt packs)
• Media asset generation: cover images, voiceover narration, promotional videos, sales copy, and Pinterest pins
• An AI assistant ("Chef Kupkaike") for product strategy and creative guidance

The Platform uses a credit-based system ("cupcakes" or "engine credits") for accessing features. Features may change, be added, or removed at any time with reasonable notice.

3. Accounts & Registration

You must provide accurate information during registration. You are responsible for maintaining the security of your account and for all activities that occur under it.

One account per person — shared accounts are not permitted. We may suspend or terminate accounts that violate these Terms.

You can delete your account at any time by contacting support@kupkaike.com.

4. Credits & Payments

• Products are purchased through Stripe as one-time packs (First Win $14 / 1 product, Duo Pack $19 / 2 products, Six Pack $49 / 6 products) or monthly subscriptions (Creator $39/mo, Pro $89/mo).
• Credits are non-transferable between accounts.
• Credits do not expire as long as your account is active.
• Prices are in USD and may change with 30 days notice.
• All payments are processed securely by Stripe — we never store credit card information.
• 2 free credits are provided upon account creation.

5. Refund Policy

• Unused credit packs may be refunded within 7 days of purchase by contacting support@kupkaike.com.
• Credits that have been partially or fully used are non-refundable.
• If a technical error causes credits to be deducted without delivering the expected output, we will refund those credits to your account.
• Chargebacks or payment disputes will result in immediate account suspension pending review.

6. AI-Generated Content & Intellectual Property

Products, text, images, voiceovers, videos, sales copy, and other content generated through Kupkaike are created using artificial intelligence (Anthropic Claude, OpenAI DALL-E, OpenAI TTS, Kling Video).

You retain full commercial rights to use, sell, modify, and distribute the products you generate on the Platform.

However, Kupkaike does NOT guarantee that AI-generated content is eligible for copyright registration in any jurisdiction — copyright law regarding AI-generated works varies by country and is evolving.

You are solely responsible for:

• Verifying that your products do not infringe on existing copyrights, trademarks, or intellectual property
• Complying with the terms of service of platforms where you sell (Gumroad, Etsy, Amazon KDP, etc.)
• Disclosing AI involvement in content creation if required by the selling platform's policies
• Ensuring the accuracy of any claims, data, or information in your products

Kupkaike is not liable for any claims, damages, or losses arising from the sale or distribution of products created on the Platform.

The Kupkaike brand, logo, market intelligence system, and platform design are owned by Le Flexible and may not be reproduced without permission.

7. Market Intelligence & Data Disclaimer

• The market intelligence engine uses publicly available web data and AI analysis to provide market insights.
• Opportunity scores, risk assessments, trend predictions, revenue simulations, strategic recommendations, and all other intelligence outputs are estimates and projections — NOT guarantees.
• Market conditions change rapidly — data may become outdated between the time of analysis and your action.
• Revenue simulations are illustrative projections based on market data and statistical models — they are NOT financial advice.
• Kupkaike is NOT a financial advisor, investment advisor, or business consultant.
• You should conduct your own due diligence and consult qualified professionals before making business decisions based on scan results.
• We are not liable for any business losses, missed opportunities, or financial damages resulting from reliance on our market intelligence.

8. Acceptable Use Policy

You agree NOT to:

• Generate illegal, harmful, defamatory, discriminatory, or deceptive content
• Mass-generate spam products or low-quality content intended to flood marketplaces
• Use the Platform to create content that infringes on others' intellectual property
• Resell access to the Kupkaike platform or share your account credentials
• Attempt to reverse-engineer, scrape, or extract our proprietary algorithms or data
• Use automated bots or scripts to interact with the Platform
• Circumvent rate limits, credit costs, or security measures
• Use the Platform for any purpose that violates applicable laws

Violation of these terms may result in immediate account termination without refund.

9. Affiliate Program

Kupkaike offers an affiliate program allowing users to earn commissions by referring new users. Affiliates receive a unique referral link (kupkaike.com/?ref=CODE).

Kupkaike reserves the right to modify commission rates with 30 days notice, terminate any affiliate account for fraud or violation of these Terms, and withhold commissions pending fraud investigation.

10. Limitation of Liability

Kupkaike is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.

We are not liable for:

• Loss of data, revenue, or business opportunities
• Inaccuracies in market intelligence or AI-generated content
• Third-party actions (Stripe, selling platforms, etc.)
• Service interruptions due to maintenance, updates, or technical issues

Our total liability is limited to the amount you paid to Kupkaike in the 12 months preceding the claim.

11. Governing Law & Disputes

These Terms are governed by the laws of Quebec, Canada. Any disputes will be resolved in the courts of Quebec, Canada.

Before initiating legal action, you agree to attempt to resolve disputes through email correspondence with support@kupkaike.com.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-platform notification. Continued use of the Platform after changes constitutes acceptance.
